I love the litigation aspect of it,” Jason said. “Shy of criminal law, we are the most active in terms of trials. Our attorneys are in court all the time, arguing bench trials before a judge. You get an opportunity to sharpen your litigation skillset nonstop.”

Q: What are trends you’ve noticed about family law?
A: “One easy trend is how big a role social media has played. Once upon a time, people had more privacy, but now with social media and cell phones everything from affairs to spending habits are easier to discover. Suspicious behavior in general is a lot easier to investigate than it once was. Also, the younger demographic seems savvier when dealing with divorce. I’m noticing younger clients possess a more sophisticated understanding of the law which makes them great clients.”

Q: Does the media play a role in misleading people about family law?
A: “I see that all the time. A common misconception I hear is “if I leave the house am I losing rights to my home.” Another one that comes up is custody rights and whether a mother has more of a right to custody than a father. I spend quite a bit of time helping clients understand the truth about the law and what everyone’s rights are. There is a misguided assumption about mother’s having more rights than the father, it’s an old school misconception but something I hear often.”

Jason also shared some important tips for folks who are seeking or are thinking about seeking a divorce.

“When someone is considering a divorce, I tell them how do you want to have this resolved? One option is an amicable divorce, which involves a discussion of how we are going to do this. This option mitigates cost and headaches, plus it gives control over the terms to both parties. The only other option is a bench trial where a stranger in a black robe tells you how it’s going to play out. You lose control, and it could end badly with limited recourse.”

Jason says it’s important to handle the issue of divorce with as much communication as possible. “Try not to surprise your spouse with a divorce summons because it creates suspicion, creates problems where they might not exist, and so open communication is best. It also helps avoid entrenched positions.”

Finally, when it comes to children, both parties have to put their feelings aside and put the children first. “Those are the hardest ones, and it’s better for parents to decide than to leave it up to a judge. If it’s up to a judge, s/he will try to put children first, but there’s no definition for best interest”.
