Four attorneys are vowing to sue California Attorney General (AG) Rob Bonta over a ballot initiative concerning gender dysmorphia that they allege is titled in a biased, prejudicial and inflammatory manner.

The Protect Kids California organization’s ballot initiative (download petition here), if approved by voters, would require schools statewide to notify parents when their child is experiencing gender confusion.

Among the attorneys who are part of Protect Kids California is Newport Beach lawyer Nicole Pearson.

The worst case scenario if we are not successful in a lawsuit is that the ballot initiative moves forward as titled and summarized and we lose supporters,” Pearson told OrangeCountyLawyers.com. “The way it’s written is not what we promise voters.

The title of the initiative is Restricts Rights of Transgender Youth and the summary includes language, such as restricts gender-segregated bathroom facilities to persons assigned that gender at birth and prohibits transgender female students (grades 7+) from participating in female sports.

AG Bonta’s office did not respond to requests for comment.

He is just way off base in his title and summary,” said Protect Kids California spokesman Jay Reed. “He says our initiative restricts the rights of transgender kids but it actually protects kids from dangerous surgery. It doesn’t restrict any rights.

Southern California School Districts Adopt Transgender Parental Notification Policies

Temecula Valley Unified, Chino Valley Unified, Orange Unified and Placentia-Yorba Linda Unified have already adopted parental notification policies.

The parent has more authority over the upbringing of the child than the government does,” Reed told OrangeCountyLawyers.com. “There is no right for the government to keep secrets from the parent.

While Orange Unified became the first school district in Orange County to require a certified staff member or principal to inform parents if their child is requesting to use a different name, Placentia-Yorba Linda Unified adopted a policy that only requires school counselors to notify a student’s parents or guardian about mental health concerns.

AG Bonta has been strict in his opposition.

Last year, he sued Chino Valley Unified School District because its parental notification policy allegedly infringed on state protections that safeguard students’ civil and constitutional rights by requiring schools to inform parents if their child identifies as the opposite sex.

As previously reported in the Press Enterprise, San Bernardino Superior Court Judge Thomas Garza ruled, on Sept. 6, 2023, in favor of Bonta’s request for a temporary restraining order.

Like other counties, Orange County has succumbeded to far left radical thinking,” Reed said in an interview. “What we’ve seen in Orange County over the last 10 to 15 years is this ideology permeate a very strong conservative county.

Other attorneys who are helping Protect Kids California are C. Erin Friday, Scott Davison, and Jennifer Kennedy.

But before Californians can vote on the initiative in the general election, Protect Kids California is charged with collecting 546,651 signatures by May 28.
